Who we are
QCODE LLC operates Tear Stones at tearstones.com. This policy explains how we collect, use and disclose personal information when you browse our store, place an order, request a custom design, contact us or use related services.
Privacy contact: support@tearstones.com
Business mailing address: QCODE LLC, 30 N Gould St, Sheridan WY 82801, United States.
Our store is hosted by Shopify. Where this policy and our Terms of Service address personal-information processing differently, this policy governs that processing, subject to applicable law.
Information we collect
Depending on your interaction with us, we collect or receive:
- Contact and delivery information, including name, email, phone number, billing and shipping addresses.
- Order and transaction information, including purchased or considered products, selected sizes and specifications, payment status, transaction references, cancellation requests, payment disputes and after-sales records.
- Account information used by Shopify customer accounts, including account identifiers and sign-in or account activity.
- Messages, design instructions, reference images and photographs or videos you supply for an inquiry, custom order or service claim.
- Device and usage information, such as IP address, browser and device details, cookies or similar identifiers, pages viewed, referrals and interactions with products or checkout.
- Marketing preferences and records of privacy requests or consent choices.
Payment providers handle the payment credentials supplied through their payment services. We receive payment confirmations and transaction information needed to manage your order. Please do not send full payment-card details or other unnecessary sensitive documents by email or through a general contact form.
Information comes from you, automatically through the store and its technologies, and from providers involved in payments, fraud prevention, fulfillment, delivery and customer support.
How we use information
We use personal information to process payments and orders; confirm custom specifications; arrange production and delivery; provide support, refunds and warranty services; maintain customer accounts; investigate payment disputes and prevent duplicate refunds; prevent fraud and secure the store; understand and improve the shopping experience; and meet recordkeeping and legal obligations.
We also use information for marketing and advertising where permitted by law and your choices. You can unsubscribe from marketing emails using their unsubscribe link or by contacting us. Order, service and other necessary non-marketing messages may still be sent after you unsubscribe.
Shopify and other service providers
We disclose information needed to provide these services to Shopify and providers for payments, messaging, shipping, customer support, analytics, security and business operations. Connected tools include Airwallex payment services, Shopify messaging services and FedEx shipping tools. Information is processed through a connected tool when it is used for the relevant service. These examples do not mean every provider receives every category listed above or is used for every order.
For a payment dispute, we may share relevant and necessary order, payment-verification, specification, production, delivery, communication and refund records with the payment provider, acquirer, issuing bank, card network or service provider handling that dispute. This use is limited to investigating the transaction, resolving the dispute, preventing fraud or duplicate reimbursement, and meeting legal obligations; dispute evidence is not disclosed for marketing through this process. We use information lawfully available to us rather than treating this policy as permission to obtain unnecessary sensitive credentials.
We may also disclose information where you direct us to do so; to comply with applicable law or valid legal process; to protect legal rights and prevent fraud; or in connection with a business transfer, subject to appropriate obligations. We do not publish a customer's private inquiry or design submission as a testimonial merely because it was sent to us.
Shopify collects and processes personal information to operate and improve its platform. Our store uses Shopify Network Intelligence and related enhanced services, which may combine information from interactions with our store with information from Shopify and other merchants for fraud protection, advertising and personalization. Shopify has its own responsibilities for this processing. See the Shopify Consumer Privacy Policy and Shopify Privacy Portal.
Cookies analytics and advertising
Our store and connected providers use cookies and similar technologies for essential store functions, preferences, measurement and advertising. The store also has a TikTok integration configured for web and server event access for analytics and campaign performance. Information may be shared with advertising providers for these purposes where permitted by law and applicable privacy choices.
Some advertising-related disclosure or use may be considered a sale, sharing or targeted advertising under certain US state laws. Those terms can apply even where data is not exchanged for money.
Use Your Privacy Choices to access available sale, sharing and targeted-advertising opt-out controls. Cookie controls may be displayed according to your location and the applicable settings. You may also adjust your browser controls; blocking necessary cookies can affect shopping functions.
Where applicable law requires it, a recognized Global Privacy Control signal is treated as an opt-out request for the relevant device and browser. Account-level application depends on whether the signal can be associated with your account. A browser-specific choice may need to be repeated on another browser or device. Global Privacy Control is distinct from other browser Do Not Track signals; apart from Global Privacy Control, we do not respond to other Do Not Track signals.
Your privacy rights
Depending on your residence and applicable law, you may have rights to access or obtain a copy of information, correct it, request deletion, obtain portable data, opt out of sale or sharing or targeted advertising, and appeal a decision about a rights request.
Submit a request to support@tearstones.com or use the controls linked above. For access, deletion, correction or other requests that require identity verification under applicable law, we may request information reasonably necessary to verify your identity and locate the relevant records.
We do not require account creation, sign-in or identity verification to opt out of sale, sharing or targeted advertising. We may request only information necessary to identify and process the opt-out, and we respect Global Privacy Control as described above. An authorized agent may submit a request where permitted by law. We may request proof of authority where allowed, and identity verification only for request types that require it under applicable law.
We respond within applicable legal time limits and explain any lawful reason for refusing or limiting a request. You may appeal by replying to our decision or contacting the same address. We will not unlawfully discriminate against you for exercising privacy rights. Rights may be subject to exceptions, including information needed for an outstanding transaction, security, legal obligations or claims.
Retention security and international processing
We keep information for as long as reasonably necessary for the purposes described above, taking account of order fulfillment, service and warranty needs, accounting and tax obligations, fraud prevention, disputes and applicable law. Retention periods vary by information type and purpose; an account-deletion request does not automatically erase records we must lawfully retain.
We use safeguards appropriate to the information and the services involved. No system or transmission method can guarantee absolute security.
We and our service providers may process information in the United States or other countries where our hosting, payment, support and fulfillment services operate. Where applicable law requires particular protections for international transfers, those requirements apply to the relevant processing.
Children and third-party services
Our services are intended for adult shoppers and are not directed to children under 13. We do not knowingly collect personal information from children under 13 or knowingly sell or share personal information about individuals under 16. If you believe a child has supplied information to us, contact us so we can investigate and take appropriate action.
External websites and services have their own privacy practices. A link to another service does not make this policy apply to that service's independent processing.
Changes and contact
We may update this policy when our practices or legal requirements change. We will publish the revised version, update its date and provide any notice or consent process required by law. For questions, complaints or privacy requests, contact support@tearstones.com or write to QCODE LLC at the business mailing address above.
